Terms of Service

Draft: this document is still being reviewed and isn’t in effect yet.

These terms are an agreement between you and Adam Bushman, LLC, doing business as Hexplore ("Hexplore", "we", "us"), for your use of the Hexplore website and app. By creating an account or using Hexplore, you agree to them. If you don't agree, please don't use Hexplore.

Who can use Hexplore

You must be at least 16 years old to create an account. If we learn that an account belongs to someone younger, we'll delete it.

You're responsible for your account: keep your password safe, and tell us at [email protected] if you think someone else has used it. One person per account.

What Hexplore is

Hexplore lets you make maps of the places you've been, where each place is a hexagon that shows a color, a badge or a photo. You can keep a photo library, organize trips, export your maps as images and share them with a link.

What you can do depends on your plan:

  • Free lets you make color maps.
  • Buying a map unlocks more for that one map, for as long as Hexplore exists: badges, or badges and photos, every export option without a watermark, and sharing it with a link.
  • Lifetime is a one-time purchase that unlocks everything on every map, plus trips and your photo library.

The pricing page lists what each plan includes. We may change features over time.

Your content

Your photos, maps, captions and trips are yours. You keep every right you have in them.

So that Hexplore can work, you give us permission to store, copy, resize and display your content, only to provide Hexplore to you and to the people you share it with. This permission ends when you delete the content, except for copies that take time to clear from backups, as the Privacy Policy explains.

When you share a map with a link, anyone with the link can see that map and the photos on it, at a reduced size. Turning the link off stops the page, but you can't take back what someone has already seen or saved.

You're responsible for what you upload and share. Only upload photos you have the right to use, and don't upload anything that:

  • is illegal, or infringes someone else's copyright, privacy or other rights;
  • sexually exploits or endangers anyone, especially minors;
  • harasses, threatens or promotes violence against anyone;
  • contains malware or tries to break, overload or get around how Hexplore works.

We may remove content or close accounts that break these rules.

Paying

Payments are handled by Paddle, our reseller and merchant of record, under Paddle's own terms. Prices are shown before you pay, and Paddle adds any sales tax or VAT that applies.

  • A bought map is a one-time purchase for that map. It stays yours for as long as you keep your account. A bought map can't be deleted on its own; deleting your account deletes it.
  • Lifetime is a one-time purchase for your whole account. It doesn't renew, and stays yours for as long as you keep your account. What you paid for maps you still have may come off its price, as the upgrade shows before you pay.
  • Photos you can't use without Lifetime, such as one replaced on a bought map, are kept for three months, so they're there if you get Lifetime, and are then deleted.
  • What you buy is digital. A bought map, Lifetime and the files you download are digital. Nothing physical is made or shipped; you print your map yourself, wherever you like.
  • Refunds follow our Refund Policy.

We may change prices. A new price applies to purchases made after the change.

Gifts and giving maps away

You can give someone a map you bought, and, once payments are available, a blank map or Lifetime.

  • Making maps for others is allowed, including as a paid service, such as making a map from a customer's photos and giving it to them.
  • When you give a map away, you choose whether its photos are copied, so you keep yours, or moved, so they leave your library. A photo you use on another of your maps is always copied.
  • A gift waits until the person it's sent to accepts it with a verified account at that email address. Gifts don't expire. Until it's accepted, you can cancel it.
  • Once accepted, a gift can't be undone. The map and its purchase become theirs, and leave your account, along with your exports of it.
  • A gift depends on the payment behind it. If that payment is reversed, the gift is reversed wherever it now is.
  • Only send photos you have the right to share with the person you're giving the map to.

Copyright and takedowns

We respect the rights of photographers and other creators. If you believe something on Hexplore infringes your copyright, send a notice to [email protected] with:

  1. your name, address, phone number and email address;
  2. a description of the copyrighted work;
  3. where it appears on Hexplore, such as the link to the shared map;
  4. a statement that you believe in good faith that the use isn't authorized by the owner, its agent or the law;
  5. a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for them;
  6. your physical or electronic signature.

We'll remove or disable access to the material, and tell the person who posted it. If you believe your content was removed by mistake, you can send a counter-notice to the same address. We close the accounts of people who repeatedly infringe.

Deleting your account

You can delete your account at any time from Settings. Deletion happens after 7 days, and signing in during that time cancels it. After that, everything personal is deleted for good, including maps you bought. What you paid for them can't be refunded or moved to another account. The Privacy Policy explains what we keep and why.

We may close or suspend an account that breaks these terms.

Hexplore is provided as is

We work hard to keep Hexplore running and your content safe, but we can't promise that Hexplore will always be available, free of errors, or that content will never be lost. Keep your own copies of photos that matter to you. To the extent the law allows, Hexplore is provided "as is", without warranties of any kind.

Limits on our liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost data, profits or goodwill. Our total liability for any claim about Hexplore is limited to the greater of what you paid us in the 12 months before the claim, or $50.

Some places don't allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under the law that can't be waived.

Disputes

These terms are governed by the laws of the State of Utah, without regard to its conflict of laws rules. Any dispute about them or about Hexplore will be resolved in the state or federal courts in Davis County, Utah, and you and we agree to their jurisdiction. If you're a consumer in a country whose laws give you the right to bring a claim where you live, that right still applies.

Changes to these terms

We may update these terms. If a change matters, we'll tell you by email or in the app before it takes effect. Continuing to use Hexplore after that means you accept the new terms.
